THE HIGH TECH INVENTORS ALLIANCE (HTIA) HAS BEEN AN ADVOCATE FOR BALANCED REFORMS AT THE US PATENT AND TRADEMARK OFFICE, THE US COURTS, AND CONGRESS, ADDRESSING THE ROOT CAUSES OF PATENT LITIGATION ABUSE WHILE PROMOTING A PATENT SYSTEM THAT ENCOURAGES INVESTMENT IN NEW TECHNOLOGIES AND AMERICAN JOBS. THOSE REFORMS INCLUDE:- IMPROVING PATENT QUALITY;- SUPPORTING THE INTER PARTES REVIEW PROCEDURE OF THE AMERICA INVENTS ACT;- MAKING PATENT LITIGATION FAIR AND EFFICIENT;- APPLYING DAMAGE AWARDS THAT ARE FAIR AND SUPPORT INNOVATION.IN 2023, HTIA ACTIVELY PARTICIPATED IN THE POLICY-MAKING PROCESS BY SUBMITTING COMMENTS AND RECOMMENDATIONS TO THE USPTO. HTIA SUPPORTED THE PROPOSED RULE GOVERNING PRE-ISSUANCE INTERNAL CIRCULATION AND REVIEW OF DECISIONS AT THE PATENT TRIAL AND APPEAL BOARD (PTAB), WHICH INCLUDES A PROVISION TO PROTECT THE INDEPENDENCE OF PTAB. IN ADDITION, HTIA PROPOSED MODIFICATIONS TO ENHANCE THE POLICY GUIDANCE WITHIN THE SAME RULE. HTIA ALSO EXPRESSED CONCERNS REGARDING THE ADVANCE NOTICE OF PROPOSED RULEMAKING ABOUT DISCRETIONARY INSTITUTION PRACTICES AT THE PTAB THAT COULD POTENTIALLY RESTRICT ACCESS TO PATENT REVIEW PROCEEDINGS IN VARIOUS CASES. IN ADDITION, THE ALLIANCE PROVIDED FEEDBACK ON THE EMERGENCE OF ARTIFICIAL INTELLIGENCE, STRESSING THAT AI SHOULD BE SEEN AS A TOOL AIDING HUMAN INVENTORS RATHER THAN BEING ACKNOWLEDGED AS AN INVENTOR ITSELF. ADDITIONALLY, HTIA HAS ADDRESSED THE ISSUES SURROUNDING THIRD-PARTY LITIGATION FUNDING, ESPECIALLY THE LACK OF TRANSPARENCY AND THE INFLUENCE OF FUNDERS IN THE LITIGATION THEY SPONSOR. THE ALLIANCE HAS RAISED THESE ISSUES IN JOINT COMMENTS ON THE FEDERAL RULES OF CIVIL PROCEDURE AND HIGHLIGHTED THEM IN A JOINT LETTER TO THE U.S. HOUSE JUDICIARY SUBCOMMITTEE.
